Private legal practitioner Martin Kpebu has criticised the Office of the Special Prosecutor (OSP) for its handling of the case involving former Finance minister Ken Ofori-Atta.
His criticism particularly focuses on how the former minister left the country for medical reasons at a time when the prosecutorial body was investigating him and others in the SML case.

According to Kpebu, who is known for his persistent criticism of the OSP, he believes that Ghanaians could have assisted the OSP in preventing Ofori-Atta from leaving the country if the office had informed the public.
Speaking on JoyNews on November 19, 2025, he said, “Hey, people of Ghana, I have clear evidence Ofori-Atta is about to travel out of Ghana. I’ve gone to these institutions, they are not helping me, so come and help. Do you know how many people would have taken steps to besiege the airport to prevent Ofori-Atta from traveling.”
The lawyer also argued that, during the same period, the Operation Recover All Loot (ORAL) committee was actively working.
He added that they could have assisted the OSP, as the security agencies were allegedly unwilling to help, according to the OSP.
“And even at that time, I was part of the ORAL team, we were working. We had security capos, Kofi Boakye is on the ORAL team and there were people in the back room who were supporting. The key thing is that he says he got the letter.

“Ofori-Atta says I’m traveling well for medicals. Let’s leave out the reasons but the main thing is he says he’s going out of Ghana. Kissi Agyebeng had the letter and sat on the letter,” he noted.
Kpebu’s criticism comes amid heightened public scrutiny of the OSP’s handling of high-profile cases and ongoing public debate over the Special Prosecutor’s actions, transparency, and accountability.
