South Dakota Board of Elections Reviews 2026 Legislative Proposals

The South Dakota Board of Elections is reviewing 17 proposed changes ahead of the 2026 legislative session, which begins Jan. 13.

Among the ideas presented by Secretary of State Monae Johnson and Deputy Tom Deadrick:

• Ballot on demand: County auditors could print customized ballots at polling places. Supporters say it improves ballot tracking and security.
• Candidate filing fees: A proposal allowing candidates to pay to get on the ballot drew sharp criticism from board members, who called it “pay to play.”
• Signature requirements: A suggested change would alter how many signatures candidates need, potentially favoring Republicans. Critics argued it could disadvantage Democrats and independents.
• Single-subject rule: Deadrick proposed removing the Secretary of State’s role in certifying whether ballot measures meet the constitutional single-subject requirement, citing legal risks. He said courts should handle disputes.

The Legislative Research Council is drafting the proposals for possible introduction in the upcoming session.
